This document establishes the terms and conditions for using the website www.europeanfood.ro. Accessing and browsing this site refers to each user/visitor individually and implies full acceptance, without any other procedure, of these terms and conditions.

S.C. EUROPEAN FOOD S.A., hereinafter also referred to as the Owner or Operator, reserves the exclusive (unilateral) right to update, modify, delete the “Terms and Conditions” mentioned in this section, without prior notice, with such modifications coming into effect at the moment of their publication on the website www.europeanfood.ro. The user will be notified of these changes upon browsing this section, thus S.C. The website www.europeanfood.ro is a presentation and information site to the public that includes images, texts, videos, brands, information regarding the activities of the company S.C. EUROPEAN FOOD S.A., being its property.

These terms and conditions are subject to Romanian law. The language used in communication is Romanian.

The Owner will try to amicably settle any conflict that arises between him and the visitor/user.

In case it is not possible to amicably resolve any conflicts arising between the Owner (S.C. EUROPEAN FOOD S.A.) and the user/visitor, the legal provisions in this field will apply, with potential disputes being resolved by competent Romanian courts.

 

Force Majeure

Neither party is responsible for the non-performance on time and/or improper performance, in whole or in part, of any of their obligations, if this is due to a force majeure event, as defined by law.

If within 10 (ten) days from the occurrence, the event does not cease, the parties have the right to notify each other of the termination by right, without either of them claiming damages.

As we are interested in improving the performance of our services, S.C. EUROPEAN FOOD S.A. establishes the technical and organizational measures to ensure the security and confidentiality of personal data, having the obligation to manage safely and only for specified purposes, the personal data provided by users. At the same time, we reserve the right to periodically update the privacy policy in accordance with the laws in force applicable on Romanian territory and to make it available to the public free of charge. It must be mentioned that the transmission of information or photos/videos through the website or our email address implies S.C. EUROPEAN FOOD S.A.’s access to this information. In this case, S.C. EUROPEAN FOOD S.A. will not be obliged to pay any compensation that the sender or any third party might claim. Disclosure to third parties will be made in accordance with the provisions of this document.

  • Restriction of processing means the marking of stored personal data with the aim of limiting their processing in the future;
  • Profiling means any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a natural person, in particular to analyze or predict aspects concerning that natural person’s performance at work, economic situation, health, personal preferences, interests, reliability, behavior, location or movements;
  • Controller means the natural or legal person, public authority, agency, or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data;
  • Processor means a natural or legal person, public authority, agency, or other body which processes personal data on behalf of the controller;
  • Recipient means a natural or legal person, public authority, agency, or another body to which the personal data are disclosed, whether a third party or not.
  • Third party means a natural or legal person, public authority, agency, or body other than the data subject, controller, processor, and persons who, under the direct authority of the controller or processor, are authorized to process personal data;
  • Data subject’s consent means any freely given, specific, informed, and unambiguous indication of the data subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her;
  • Personal data breach means a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to, personal data transmitted, stored, or otherwise processed;
  • Representative means a natural or legal person appointed in writing by the controller or processor, who represents the controller or processor with respect to its obligations;
  • Supervisory authority means an independent public authority established by the Romanian state;
  • International organization means an organization and its subordinate bodies governed by public international law, or any other body that is set up by, or on the basis of, an agreement between two or more countries or under such an agreement.
  • Anonymous data means data which, due to its origin or specific method of processing, cannot be associated with an identified or identifiable person.

 

What Personal Data Do We Collect and From Whom?

 

We process the personal data received from you. We inform you that we will collect the following personal data:

  • Directly: name and surname, email address, telephone number, received from you via telephone, email, or through the contact form in the “Contact” section of the website www.europeanfood.ro
  • Indirectly/Involuntarily: IP Address – when you visit our website or when you send a message to our email address or through the contact form in the “Contact” section of the site, your IP address is recorded. Operating system, browser, site activity – this information may be processed through the use of cookies.
  • At the same time, we inform you that when you send a message to our email address or through the contact form on the site, you understand that you are expressing your explicit and unequivocal consent for the use of personal data for the purpose of being contacted and receiving a response to your message. The collected data are limited to what is strictly necessary in relation to the purposes for which they are processed, in compliance with legal measures of data security and confidentiality. We do not collect and process special personal data that reveal racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, genetic data, data concerning a person’s sex life or sexual orientation. We must inform you that you are not obliged to send/provide us with any personal data, and not providing them is not a necessary requirement for browsing the site. We inform you that S.C. EUROPEAN FOOD S.A. makes all efforts in terms of protecting your data, using security methods and technologies, along with policies for the confidentiality of the collected data. However, we must inform you that the complete security of data transmitted over the internet cannot be 100% guaranteed, with the risk that the data may be seen and used by unauthorized third parties. Purpose of Processing

S.C. EUROPEAN FOOD S.A. processes your personal data within Romania and does not intend to transfer these personal data to a third country or an international organization.

  • Employees of S.C. EUROPEAN FOOD S.A. who have access to your data in the course of performing their duties, strictly within the limits of their professional and service competencies;

  • Central and local government institutions/authorities, courts, police, prosecutor’s offices, etc.

S.C. EUROPEAN FOOD S.A. does not provide data collected from users to third parties without the express and prior consent of the users.

 

Period of Processing Personal Data

The data are stored and archived for the entire period of our activity (S.C. EUROPEAN FOOD S.A.), until the moment you or your legal representative exercise your right to object/to erase, except for the case where we have a legal obligation to continue storing your data according to the GDPR Regulation.

Thus, you have the right to request us to delete your data or certain data of yours at any time during our activity.

To exercise your rights, you can address a written request, signed and dated, to the attention of the Data Protection Officer, at the email address marketing@europeanfood.ro or by mail/courier to the following correspondence address: Teatrului Street, No. 7, Oradea, Bihor County.

If necessary, S.C. EUROPEAN FOOD S.A. may ask you to provide additional information to establish the identity of the individual submitting the request (Art. 12, para. (6) of the GDPR Regulation).

We will not charge a fee for the request to exercise your rights, except in cases where the requests are manifestly unfounded or excessive, especially due to their repetitive nature, in which case we are entitled to:

  • either charge a reasonable fee considering the administrative costs of providing the information or communication or for taking the requested actions;

We will inform you of the fee that would apply before resolving your request.

  • or refuse to comply with the request.

We commit to responding to any request, which does not negatively affect the rights and freedoms of other data subjects, within a maximum of one month from its receipt, except in cases where the requests are complex or you have made several requests, in which case we will respond within a maximum of two months.

Any illegal attempt to access by any method/means or to request the personal data of another user can be interpreted as an attempt at fraud and may lead to a criminal investigation against the applicant.

In accordance with the provisions of Regulation (EU) No. 679/2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, hereinafter referred to as the GDPR Regulation, by going through this document we inform you of your rights:

  • The Right to Lodge a Complaint with the National Supervisory Authority for Personal Data Processing and to seek a judicial remedy if you believe that the processing of your data infringes the GDPR Regulation.
